CONDITIONS OF CARRIAGE

In Greece and Internationally


1. As used in this contract "ticket" means this passenger ticket and baggage check. The term “electronic ticket” means the itinerary/receipt if applicable, issued by or on behalf of Pegasus Aviation LTD, the electronic voucher, or / and the boarding pass. The following terms and conditions and the terms and conditions attached to the electronic ticket, constitute part of these tickets and are completely binding for both Pegasus Aviation LTD and the passenger. These terms prevail over any other regulation of Pegasus Aviation LTD dealing with particular subjects. For better comprehension of those terms and conditions, “damage” is considered as potential death, injury, delay, partial or total loss or any other damage, deriving or relating to the carriage and any other similar services, as they are carried out by the carrier.

2. As far as flights within Greece are concerned, carriage hereunder is subject to Regulation (EC) 261/2004 and the rules of the Greek Aviation Code (Law 1815/88). According to these rules, Pegasus Aviation LTD’s liability is limited and cannot exceed (a) for death or bodily injury in case of passengers’ carriage the amount of eleven thousands seven hundred thirty eight Euros and eighty one cents (11.738,81 €) for each passenger, (b) for total or partial loss, destruction, deterioration or delay in case of registered baggage carriage the amount of eleven Euros and seventy four cents (11,74 €) per kilo and (c) the obligation of Pegasus Aviation LTD for compensation cannot exceed the amount of eighty eight Euros and four cents (88,04 €) for all the objects carried by the passenger , except if bigger value has been stated before and additional charges have been applied, according to the invoices or the rules of Pegasus Aviation LTD.. In that case, Pegasus Aviation LTD’s liability is limited up to the value stated in the beginning. In no case shall Pegasus Aviation LTD’s liability exceed the real damage, as occurred to the passenger. In all cases and for each case separately, the amount of the damage must be proved. The above mentioned limits may be altered exclusively by the issuance of a decree.

3. As far as international flights are concerned, carriage hereunder is subject to the provisions of the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at The Hague, 28th September 1955, at Guatemala on 8th March 1971 and at Montreal on 25th September 1975, or the Montreal Convention 1999, whichever may be applicable. Pegasus Aviation LTD’s liability is limited as far as international flights as well and cannot exceed the amounts described in the previous paragraph.

4. Regardless of the agreement, as incorporated in the present contract or other law in power: (a) Pegasus Aviation LTD bears no liability for damages to passenger or baggage, which is not registered in the ticket, except for the case that the damage is caused by its gross negligence, (b) Pegasus Aviation LTD bears no liability for any damage caused directly and exclusively by the blind execution of laws, State regulations, rules or orders, which it is obliged to respect and apply, (c) Pegasus Aviation LTD bears no liability for any damage caused by the non compliance of the passenger with all the above mentioned laws, regulations and rules, (d) any exception or limitation of Pegasus Aviation LTD ‘s liability, as it is defined by the present terms and conditions, will apply to agents, employees or representatives of Pegasus Aviation LTD, as well as to anyone whose aircraft is used by Pegasus Aviation LTD for the carriage and his agents, employees or representatives, (e) baggage, which is not registered to the ticket and are carried, according to the terms and conditions of the present agreement, will be delivered to the holder of the baggage check, provided that he pays to Pegasus Aviation LTD the respective amounts, as defined and owed according to the contract or the respective invoice. In case of damage caused to baggage, a written complaint shall be addressed to Pegasus Aviation LTD, immediately after the discovery of the damage, the latest seven (7) days after the delivery and in case of delay the latest (21) days by the day that the baggage should have been delivered to the passenger.

5. When validated, the ticket is valid for carriage from the port at the place of departure to the port at the place of destination via the route shown therein and is valid for one year from the date of issue. Each flight coupon will be accepted for carriage on the date and flight for which accommodations will be reserved when flight coupon is issued on an 'open date' basis, accommodations will be reserved on time upon application subject to availability of space.

6. Pegasus Aviation LTD will take all necessary measures to ensure that passengers and baggage are carried expeditiously. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract. Pegasus Aviation LTD may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Pegasus Aviation LTD is free to draft the flight schedule and under normal circumstances it shall conduct the flights, according to the way they are published in the website. Pegasus Aviation LTD is not liable for any deviation or change of the scheduled itinerary, which takes place due to bad weather conditions and Governmental or Coast Guard orders or due to force majeure.

7. In case of cancellation of a flight, Pegasus Aviation LTD is obliged to inform the passengers about the cancellation in question as soon as possible, except for the case that unpredicted circumstances do not allow him to do so (e.g. cases of political instability, weather conditions, dangers for passengers’ security, unprecedented lack of flight security, strikes). In case of any cancellation, Pegasus Aviation LTD shall inform the passengers about their rights and its intention to offer them the following solutions: (a) return their ticket price, (b) take over to carry them to the port of their destination in satisfactory conditions. This means that they can be carried to their destination, without having to meet any costs, by the next scheduled flight of the carrier or by other means of transport, either public or private (e.g. ferry – boat, boat), indicated by Pegasus Aviation LTD. In addition, in any case, passengers are entitled to compensation, as provided by article 7 of Regulation (EC) 261/2004, except for the following cases : (a) if they have been informed about the cancellation at least 2 weeks before the scheduled time of departure or (b) if they have been informed about the cancellation for 2 weeks before the scheduled time of departure and Pegasus Aviation LTD provides them with transportation by an alternative flight, that allows them to depart not more than 2hrs earlier than the scheduled time of departure and reach their final destination in less than 4hrs after the scheduled time of arrival or (c) they have been informed about the cancellation less than 7 days before the scheduled time of departure and Pegasus Aviation LTD provides them with transportation by an alternative flight, that allows them to depart not more than 1hr earlier than the scheduled time of departure and reach their final destination in less than 2hrs after the scheduled time of arrival. In case the cancellation occurs due to unpredicted circumstances, which could not have been avoided by Pegasus Aviation LTD, even if it had taken all appropriate measures, (e.g. cases of political instability, weather conditions, dangers for passengers’ security, unprecedented lack of flight security, strikes), Pegasus Aviation LTD again is not obliged to act according to the previously mentioned (a) and (b) cases and is not obliged to pay any indemnification.

8. In case of a flight delay, Pegasus Aviation LTD is obliged to inform the passengers about the delay in question, except for the case that unpredicted circumstances that could not have been avoided by Pegasus Aviation LTD, even if it had taken all appropriate measures, do not allow it to do so. In case of any delay more than 5hrs, the passengers are entitled: (a) cancel their flight and receive a refund for the unused portion of the ticket, (b) to be carried to the port of their destination in an alternative way. In case that it is extremely urgent for them to reach their destination on time, they can be carried, without having to meet any costs, by other satisfactory means of transport, either public or private (e.g. ferry-boat, boat), indicated by Pegasus Aviation LTD. In case that the delay is less than 5hrs, Pegasus Aviation LTD provides passengers with refreshments and phone calls. In case that passengers are required to overstay at night, Pegasus Aviation LTD is obliged to cover the hotel expenses and transportation of passengers there. In any case of delay, passengers are not entitled of indemnification.

9. In case there is a denial of boarding in a flight, where there is a confirmed booking and the passenger has complied with the terms of paragraph 10 and 11 of the present, and the denial does not take place due to serious reasons (health, flight security or air security, or lack of travel documents) Pegasus Aviation LTD shall first call for volunteers. If, after the exhaustion of volunteers, there is a denial of boarding, Pegasus Aviation LTD provides care to passengers and informs them that they are entitled (a) to receive a refund for the unused portion of the ticket (b) be carried to the port/airport of their destination in an alternative and satisfactory way. Additionally, passengers are entitled to compensation according to article 7 of Regulation (EC) 261/2004.

10. Passengers will take all necessary measures, in order to comply with all domestic and international provisions, concerning the conduct of this carriage, as well as with any orders or instructions by the crew about the security and regularity of the carriage.

11. The tickets are non-endorsable or transferable. Passengers are obliged to have a confirmed book in the specific flight and to arrive at the port of departure, where the check –in takes place, 25 minutes before the scheduled departure. Passengers are obliged to show before departure their identity cards, or passport, or driving license, in order to be identified.

12. Pegasus Aviation LTD is not liable for any passenger’s delay in arrival to the port of departure or delay in embarkation. As a result the carrier has no responsibility for the extra costs that the passenger has undertaken because of not complying with the above (par. 10) rules. In any case no refunds are in progress after the airplane’s departure.

13. Carriage of pets is subject to the Pegasus Aviation LTD‘s approval. It is contingent on the fact that the animals are properly crated in kennels and accompanied by valid health and vaccination certificates. Pegasus Aviation LTD reserves the right to determine the manner of carriage and limit the number of animals, which may be carried on a flight. Pets and kennels cannot travel in the passenger compartment of Pegasus Aviation LTD’s aircraft. The weight of accompanied pets, including the weight of containers and food carried shall not be included in the free baggage allowance of the passenger but shall be charged to and paid by the passenger at the rate applicable to excess baggage. “Seeing-Eye” dogs and service dogs, together with containers and food will be carried free of charge in addition to the normal free baggage allowance. The passengers’ dependence upon an escort dog must be proved by a medical certificate. Pegasus Aviation LTD will have no liability for any damages caused by a pet to others, except for the case that the damage is caused by its gross negligence or wilful misconduct.

14. Baggage allowance is limited to 12 kilos per person per flight. Where load permits, Pegasus Aviation LTD will also take baggage over this limit, on payment of an excess baggage fee of € 2.00 per kilo per sector. In addition, any piece of checked baggage, which individually exceeds the limit of 12 kg, may need to be transported at a later flight or by another means of transport. There is a maximum single item weight of 30 kg. Infants are not entitled to a baggage allowance. It is provided that passengers, who want any piece of baggage weighing more than 12 kg, to travel with them on the same flight, may book and pay for an extra seat. Extra seats must be booked in advance. An extra seat must also be purchased in advance for the purpose of accommodating oversized baggage items, which must be carried on board, such as musical instruments. Outsize items requiring additional handling will be charged at € 15.00 per sector per item with additional charge at € 2.00 for each kilo, exceeding the weight limit of 12 kg. Carriage of such items is at Pegasus Aviation LTD‘s discretion.

15. Passengers may carry on board (1) item of hand baggage weighing up to 12 kg and not exceeding dimensions 55cm x 40cm x 20cm. All hand baggage will be searched for prohibited items and will be stored in the baggage compartment of the aircraft. No hand baggage is permitted in the passenger cabin.

16. In the unlikely event that checked in baggage is lost, damaged or stolen whilst in the care of Pegasus Aviation LTD or one of our ground handling agents, this should be immediately reported to the ground handling staff upon arrival at the destination. Passengers must ensure that a Property Irregularity Report (PIR) is completed before they leave the port of arrival. Pegasus Aviation LTD makes every effort to locate within lost bags, and resolve the disorer. Most delayed bags are located within 48 hours and returned as soon as possible.

17. In case that Pegasus Aviation LTD denies the carriage of baggage, for any reason, apart from an emergency as defined in par.7 of the present terms, it is obliged to follow the procedures in paragraph 7 of the present contract.

18. No agent or employee or representative of Pegasus Aviation LTD is entitled to amend or void any provision of the present contract.

19. Pegasus Aviation LTD reserves the right to alter its fares without notice.
